Protected species of flora and fauna
Pursuant to Chapter 8 of the Environmental Code, the Government may decide to protect species of flora and fauna throughout the country or in a county. Provisions on species protection are contained in the Species Protection Ordinance (2007:845). This ordinance also contains general exceptions that apply for certain species. All wild birds and the species of flora and fauna denoted with N or n in the Annex 1 of the Species Protection Ordinance are protected throughout the country, in compliance with the EU’s Habitats Directive (92/43/EEG) and Birds Directive (2009/147/EC). Annex 2 of the Species Protection Ordinance lists other species that are protected throughout the country or in a particular county.
In addition to the protection of all wild birds and certain species of mammal under the Species Protection Ordinance, all wild birds and mammals are also protected under the Hunting Act (1987:259) and the Hunting Ordinance (1987:905). Exceptions apply for some possibilities for culling, and because there is a hunting season on some species during certain periods during the year. Fish and aquatic molluscs and crustaceans, such as mussels and shells, can be protected under the Species Protection Ordinance or under the Ordinance regarding Fishery, Aqua Culture and Fishery Trade (1994:1716).
